Duke Ellington was issued a copyright on the song in 1928. Joe King Oliver sued for payment of royalties and composer credit because the melody was the same as Kings 1923 recording of Camp Meeting Blues with his Creole Jazz Band. The lawsuit failed because King had propblems with his original paperwork which invalidated his copyright.
Duke Ellington was presented the melody from reedman Rudy jackson, who claimed it was his own composition. After the lawsuit, Ellington fired Jackson and replaced him with Barney Bigard.
